The Maldives is in the process of establishing the necessary and appropriate legal, administrative and other measures to implement its obligations under the Protocol. A Biosafety Bill has been formulated since 2021 and is currently waiting at the Attorney General's office to be scheduled in the annual agenda of the Parliament. This Bill adoption will ensure that the development, handling, transport, use, transfer and release of any living modified organisms are undertaken in a manner that prevents or reduces the risks to biological diversity, taking also into account risks to human health. There are only two staff currently employed by the CNA whose work directly relates to Biosafety. However, biosafety is a minor component of their overall responsibilities. While this is not an adequate number at the moment, when the Bill is finalised, capacity building and more human resources would be required to effectively implement the Protocol in the Maldives. Other legal instruments that indirectly apply to biosafety include: - The Environmental Protection and Preservation Act - Fisheries Law - Maldives Customs Law - Regulations for Import and Sale of Drugs in Maldives - Consumer Protection Act, - Law on Protection of Plants - Import and Export Law - A Good Agricultural Practices Certification Scheme - National Standard for Labelling Packaged Foods - National Food Safety Policy

Article 5 – Pharmaceuticals
No
EN
Maldives does not manufacture any pharmaceuticals and all the pharmaceuticals used are imported and regulated by the Ministry of Health and the Maldives Food and Drug Authority. Maldives Food and Drug Authority has developed an authorized drug list which is updated frequently and the Authority strictly regulates pharmaceutical imports, requiring that only registered and authorized importers bring approved medications into the country

The current Biosafety Bill prohibits the contained use of LMOs in the Maldives. However, this may change when the Bill becomes a Law. This Bill also sets out procedures for the transit of LMOs. After the Bill is passed, Maldives Customs Service will work closely with the Competent National Authority to ensure the safe handling and transport of LMOs in transit. According to the Maldives Customs Service, there has been no record of any LMOs being in transit during the reporting period.

The implementation of Article 11 is also addressed in the current Biosafety Bill. While this Bill is being finalised and is at the last stage to be adopted as an act, there has been no formal record of the use of LMOs for direct use as food, feed, or processing in the Maldives. But it was noted during the stakeholder consultation workshop that since biosafety is not regulated in the Maldives, the possibility of using LMOs for direct use as food, feed, or for processing is high even if not recorded

Article 12 – Review of decisions
No
EN
No
EN
Maldives has not yet taken a decision regarding any LMOs either for intentional introduction to the environment or for direct use as FFP. The mechanism for the review and change of a decision regarding an intentional transboundary movement of LMOs is given in the Biosafety Bill which is expected to come into force soon.

While the implementation of Articles 15 and 16 would start with the adoption of the current Biosafety Bill, Maldives is very new to the concept of risk assessment and risk management of LMOs. Capacity building and the use of guidance documents, as well as trainings, would be needed after the Bill is passed, to effectively implement these two Articles in the Maldives.

Other information
The Biosafety Bill has been finalized following extensive stakeholder consultations. Once the Bill is passed by Parliament, full implementation of the Protocol in the Maldives will commence through the establishment of an enabling legal framework and the involvement of relevant government agencies. However, limited capacity, technology, and financial resources are expected to remain major challenges in implementing the national legislation. As biosafety continues to be a relatively new topic to various institutions and the community, partner agencies will need to significantly strengthen their institutional and technical capacities for effective implementation of the Protocol.
